PassTenant — Terms & Conditions

Pilot service — these terms take effect on publication.

PassTenant is a service operated by Rent Paid Ltd, Company No. 14261817, Future Business Centre, Kings Hedges Road, Cambridge CB4 2HY. These terms apply between us (“we”, “us”) and you, the person who orders a PassTenant verification (“you”).

1. What PassTenant is — and what it is not

1.1 PassTenant is a voluntary tenant-verification service. For a one-off fee of £25 we carry out referencing checks on you (identity, right to rent, credit history, income and affordability, and landlord/employer references, as described at the point of order) and give you a PassTenant report you can choose to share with landlords and letting agents through a secure link.

1.2 PassTenant is entirely optional — always. It is never a condition of viewing a property, applying for a tenancy, or entering a tenancy agreement — with us, with RentPAID, or with anyone else. No landlord or agent may lawfully require you to buy PassTenant as a condition of granting, renewing or continuing a tenancy (Tenant Fees Act 2019), and we will never treat it that way. If anyone tells you PassTenant is required, do not pay — and please report it to us.

1.3 A PassTenant report is information, not a guarantee. It does not guarantee you a tenancy, a viewing, or any particular outcome, and it does not commit any landlord or agent to accept it in place of their own checks.

2. Ordering and payment

2.1 The fee is £25 including VAT where applicable, payable once, in advance, by the payment methods shown at checkout.

2.2 To provide the service we need the information and permissions we ask for at order (identity documents, consent for a credit check, and — where you choose it — read-only open-banking access for income and affordability verification through an FCA-authorised provider). If you do not provide them we cannot complete your report; clause 4 explains what we refund.

3. Your report

3.1 We aim to complete your report promptly, but timescales depend on third parties (referees, employers, data providers), so we do not promise a completion date.

3.2 Your report is valid for 3 months from the date we issue it. After that it is marked expired and share links stop working. Facts in the report speak as at the date of the checks.

3.3 You control sharing. Your report is private until you share it. You can create and revoke share links at any time from your report page (see the Privacy Notice). Revoking a link stops future access through it.

3.4 The report reflects information given by you and by third parties. We take reasonable care in compiling it but do not verify matters outside the checks described, and we are not responsible for decisions landlords or agents make based on it.

4. Refunds

4.1 Signing refund: if you sign a tenancy agreement through RentPAID within 6 months of buying PassTenant, we refund your £25 in full on request once the tenancy agreement is signed.

4.2 If we cannot complete your report because a check cannot be carried out for reasons outside your control, we will refund you in full. If you abandon the process or do not provide what we ask for within 60 days, no refund is due beyond your statutory rights.

4.3 Nothing in this clause limits your statutory rights, including the cancellation right in clause 5.

5. Your 14-day right to cancel (Consumer Contracts Regulations 2013)

5.1 You have the right to cancel this contract within 14 days of the day you place your order, without giving any reason. To cancel, email us at support@passtenant.com with a clear statement that you wish to cancel (you may use the model form at the end of these terms). We will refund all payments received from you without undue delay and no later than 14 days after you tell us you are cancelling, using the same payment method you used.

5.2 Starting early — please read. Referencing is a service. If you ask us to begin your checks within the 14-day cancellation period, you expressly request immediate performance and acknowledge that: (a) if you cancel after checks have begun but before your report is complete, we may deduct an amount proportionate to the work done; and (b) once your report has been fully delivered, you lose the right to cancel. We ask for this consent as a separate, unticked confirmation at checkout — we will not start early without it.

6. Fair use and accuracy

6.1 You confirm the information you give us is true, complete and yours. We may cancel a report (without refund, other than statutory rights) if it was obtained using false information or another person's identity.

6.2 You must not alter a PassTenant report or misrepresent its contents. Share links are for prospective landlords and agents in connection with your genuine search for a home.

7. Liability

7.1 Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be excluded or limited (including your rights under the Consumer Rights Act 2015 to a service performed with reasonable care and skill).

7.2 Subject to 7.1, our total liability to you in connection with PassTenant is limited to the greater of the fee you paid and £100, and we are not liable for a landlord's or agent's decision not to offer you a viewing or tenancy.

8. Data protection

How we handle your personal data — including the shareable financial information in your report and how link revocation works — is set out in the PassTenant Privacy Notice, which forms part of these terms.

9. General

9.1 We may update these terms for future orders; the terms in force when you order apply to your order.

9.2 These terms are governed by the law of England and Wales and the courts of England and Wales have jurisdiction (if you live in Scotland or Northern Ireland you may also bring proceedings there).
